Intellectual Property Policy

Introduction

Media.com is committed to ensuring content sharing on our platform respects copyright laws. When uploading content to Media.com, users should ensure that they only share files they have the legal right to distribute. This includes original content they’ve created—such as documents, photos, music, or videos—or files for which they’ve obtained explicit permission from the copyright holder. Keep in mind that purchasing or legally acquiring digital content (e.g., music, videos, ebooks, or software) does not automatically grant users the right to share it with others.  

By using Media.com’s content tools, users can confirm that their uploads comply with our Terms of Service and do not violate copyright laws. Users also affirm that they either own the rights to the content or have received authorization to share it.  

To protect intellectual property, Media.com enforces strict policies against repeated copyright infringement. Accounts with multiple copyright violations may be permanently terminated. We encourage all users to respect intellectual property rights and share content responsibly, creating a collaborative and legally compliant environment on Media.com.

Intellectual Property Basics

In compliance with the Digital Millennium Copyright Act of 1998 (DMCA), Media.com promptly addresses claims of copyright infringement occurring on its platform or website (the “Site”) when such claims are reported to Media.com’s Content Moderation team.

If a user is a copyright owner, authorized to act on behalf of one, or hold exclusive rights under copyright, they may report suspected copyright infringement on or through the Site. To do so, users must complete the DMCA Notice of Alleged Infringement via our Report flagging feature for our Content Moderation team to review. 

Upon receiving a properly completed notice, Media.com will review the claim and take action as it deems appropriate in its sole discretion, including removing the reported content from the Site.

Why a Complete Copyright Notice Matters

Providing a complete and accurate copyright notice is essential for Media.com to effectively address claims of infringement. A detailed notice ensures that we have the necessary information to identify the infringing content and take appropriate action swiftly. Without this information, delays in resolving the issue may occur.  

It is equally important that the individual submitting the notice is either the copyright holder or authorized to act on their behalf. This ensures that claims are legitimate and prevents misuse of the process, such as wrongful takedown requests or interference with lawful content. These safeguards help balance the rights of content creators with the integrity of the platform.

Proper notice should include the following elements:

  1. Identification of the copyrighted work that has been allegedly infringed, or,  if multiple copyrighted works are covered by this notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  2. Identification of the material or link you claim is infringing, and to which access is to be disabled. Include the URL of the link shown on the Site or the exact location where such material may be found. This allows Media.com to locate the material and remove it if notice is complete.
  3. Contact information including your name, company affiliation (if applicable), mailing address, telephone number, and email address.
  4. Provide your full legal name and your electronic (or physical) signature.
  5. Both of the following statements must be included in the body of the notice for it to be actionable:
  • “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent or the law (e.g., as a fair use).”
  • “I hereby state that the information in this notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”

This notice can be provided to the Content Moderation team via the “Report” feature:

  1. On the offending content, click “Report” and select “Intellectual Property Violation” from the drop down menu.
  2. Populate the form that appears with the information outlined above.
  3. Submit.

Actions on Reported Intellectual Property Violations

When Media.com receives a copyright claim, Media.com follows a structured process to ensure fairness and compliance with the law. 

This includes verifying the claim's completeness, assessing the validity of the complaint, and notifying the user responsible for the content. 

If necessary, the content may be temporarily removed while the issue is being resolved. Both parties have an opportunity to provide additional information, such as a counter-notice, before a final decision is made. 

Media.com ensures timely communications throughout the process and takes action in line with legal requirements and platform policies.
